§ 28-150. Maximum permissible sound levels; report of certain repeat violators.

  • (a)

    No person shall conduct, permit or allow any activity or sound source to produce a sound that is discernible beyond the property lines of the property on which the sound is being received, when measured as provided in this article, exceeds seventy (70) dB(A) at any time during daytime hours or sixty (60) dB(A) at any time during nighttime hours. The dB(A) levels set forth in this section apply to the property where the sound is being received. Any sound that when measured at the property where the sound is being received exceeds the dB(A) levels set forth in this section is a violation of this article.

    (b)

    In addition to violations based on the dB(A) levels provided in subsection (a) of this section, the acts enumerated in the followings sections of this article, among others, and regardless of dB(A) level except as otherwise specified herein, are declared to be sound nuisances, that are unreasonably loud, irritating, disturbing, or excessive sounds in violation of this article, but the enumeration shall not be deemed to be exclusive.

    (c)

    Any person or establishment that is convicted of a second offense of violating this section will result in the town filing a complaint with the state alcoholic beverage code where appropriate.
